1. Introduction
EPSF Sas is a training organization headquartered at 16 Rue de la Jeunesse – 13190 Allauch. EPSF Sas develops, offers, and delivers in-person training.
2. Purpose
These terms and conditions apply to all offers from EPSF Sas relating to orders placed by any professional client, hereinafter referred to as the “client.” Any opposing conditions, including general or specific conditions proposed by the client, cannot prevail over these terms and conditions, regardless of when they were communicated. The general terms and conditions of sale apply exclusively to the current and future commercial relations between EPSF Sas and the client. These conditions may be modified at any time, subject to updates on the EPSF Sas website. The client acknowledges that, prior to placing any order, they have received sufficient information from EPSF Sas to ensure the offer meets their needs.
3. Type of Training
Description
These provisions apply to in-person training. The training is intended for individual or group learners and takes place in France or abroad in facilities provided by EPSF Sas. The number of trainees per session ranges between 10 and 50.
Financial Conditions
All prices, expressed in the currency of the country where the training takes place, cover only the services described in the EPSF Sas offer. Unless otherwise stated, payments shall be made under the following conditions:
- Payment is made on the EPSF Sas website: tutosportexpert.com by the client via Stripe, an online payment platform, following the payment methods provided by the platform.
- Any training started is fully due.
- The price covers only the training. Accommodation, travel, and meal expenses are the responsibility of the client.
Coverage
When training is funded by the Fonds d’Assurance Formations des Professions Libérales (FIFPL) or any other organization, the participant is responsible for submitting the funding request before the training and ensuring its approval. The client must explicitly indicate on the registration form and/or training agreement any specific references or notes required for invoicing to enable reimbursement.
Orders and Availability
Training registrations are processed chronologically, and the number of participants per session is limited. Registration for a course implies the participant’s acceptance of cancellation rules. For each registration, a contract agreement is issued according to applicable regulations and systematically sent to the client, who must return it with all required documents and information.
Once registration is confirmed, EPSF Sas sends an electronic confirmation. Fifteen days before the training, EPSF Sas sends an electronic invitation to the participant specifying the date, time, and location of the training. A certificate of participation is issued to the client upon completion of the training.
4. Cancellation
Cancellation by EPSF Sas
EPSF Sas reserves the right to modify the training location, schedule, or content, postpone or cancel the training, particularly if the number of participants is deemed pedagogically insufficient or in the event of force majeure. In such cases, the client will be informed no later than 7 days before the training start date, and any fees paid will be fully refunded. EPSF Sas cannot be held liable for cancellations or rescheduling of training. Any expenses incurred by clients for travel or accommodation will not be reimbursed.
Cancellation by the Client
Unless in cases of force majeure, in-person training dates are firmly booked. Any cancellation by the participant must be confirmed via email.
Fees applicable based on the cancellation date:
- If cancellation occurs less than 15 calendar days before the training, 100% of the course fee is due.
- If cancellation occurs less than 30 calendar days before the training, 30% of the course fee is due.
- If cancellation occurs more than 30 calendar days before the training, the full amount will be refunded, minus banking fees.
5. Intellectual Property
The client is strictly prohibited from reproducing, in whole or in part, directly or indirectly, adapting, modifying, translating, presenting, commercializing, or distributing course materials or other educational resources provided without prior express written authorization from EPSF Sas or its legal successors.
6. Personal Data Protection
EPSF Sas commits to informing each trainee that:
- Personal data concerning them is collected and processed for the purpose of improving EPSF Sas’s services and tracking the validation of training according to the contract.
- In accordance with applicable laws, trainees have the right to access, modify, or rectify their personal data. To exercise this right, they may submit a request specifying their identity and email address to EPSF Sas.
The client is responsible for preserving and maintaining the confidentiality of all educational data related to the training for no longer than two years, a period deemed sufficient for training assessment.
7. Applicable Law and Jurisdiction
These terms and conditions are governed by French law. In the event of a dispute between the client and EPSF Sas concerning contract execution, an amicable solution will be sought. Failing that, the dispute shall fall under the jurisdiction of the courts of Bouches-du-Rhône (13).
